Who is concerned with the Affordable Care Act ?
The Patient Protection and Affordable Care Act, nicknamed "Obamacare" when it was first launched, is a law on patient protection and affordable care for all. It was signed on March 30th, 2010 and came into force on January 1st, 2014. This reform consists in forcing all the taxpayers to get a health insurance in USA.
Are expatriates subject to the Affordable Care Act or ACA ?
Yes and no as the status of expatriates is very specific and the President Trump has been introducing new conditions which makes it more subtle to follow the ACA. All expatriates in the US are concerned with the Affordable Care Act law if they live more than 12 months in the United States or if they have a green card. This does not mean that they have to apply to a local American ACA compliant insurance plan anymore as there are now many exemptions and only the need for a health insurance.
If you are working in an American company of more than 50 employees, you will probably have no choice and apply to the company health insurance which is then compulsory for all the employees.
Do I have to purchase an ACA compliant insurance if I already have an international health insurance ?
As long as you can show that you have an international health insurance with a minimum essential coverage, you will not have to pay a penalty anymore.
Is it more advantageous to purchase an ACA compliant insurance or an international insurance plan ?
Since the launch of the Affordable Care Act, it has always been more advantageous to pay the penalties and an international health insurance than to buy an expensive American insurance which offers usually poor benefits with high deductible. Many expats have purchased a very basic US ACA compliant insurance like a Bronze plan and added an international health coverage to be well covered for all their expenses incurred worldwide and in the US. The best option to get a proper medical coverage for the US is to compare the different international health insurance plans and choose the one which corresponds best to your needs.
